OSHA Dramatically Increases Penalties for Health and Safety Violation
Starting August 1, 2016, OSHA will begin implementing adjustments to penalties for health and safety violations. The new penalty increases were enacted by Congress in November 2015 will rise as much as 78%.
OSHA hasn’t had an adjustment to their penalties since 1990 and it appears that they’re now making up for lost time. Going forward, they will be increasing their penalties yearly based on the Consumer Price index.
Below is an example of current and new violation penalties based on the type of penalty:
|Type of Violation||Current Maximum Penalty||New Maximum Penalty|
|Serious Other-Than-Serious Posting Requirements||$7,000 per violation||$12,471 per violation|
|Failure to Abate||$7,000 per day beyond the abatement date||$12,471 per day beyond the abatement date|
|Willful or Repeated||$70,000 per violation||$124,709 per violation|
States that operate their own OSHA plans such as California, Connecticut and others are also affected as they are required to adopt maximum penalty levels that are at least as effective as Federal OSHA’s penalties.
We encourage companies to take this opportunity to review their safety training in addition to other areas of their Injury and Illness Prevention Plan. Safety training should be regularly reviewed and updated as circumstances change in the workplace that could impact employee health and safety. Failure to do so can result in significant OSHA penalties whether you’re governed by Federal or state-run plans.
